Welcome to Joyful Jellybeans. These Terms & Conditions (“Terms”) govern your use of our website and your purchase of products from us.

By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use the website.

Joyful Jellybeans (“we”, “us”, “our”) operates an online store selling toys and educational products.

2. Use of the Website

2.1 You may use this website to:

  • Browse products;

  • Place legitimate orders; and

  • Access information and content we make available.

  • Use the website for any unlawful, fraudulent or harmful purpose;

  • Attempt to gain unauthorised access to the site, its data or server;

We may suspend or terminate access if we reasonably believe you are abusing or misusing the website.

3. Products, Pricing & Availability

3.1 Product descriptions
We aim to describe products accurately and display correct images. However, colours, sizing or packaging may vary slightly from the pictures due to screen settings, supplier changes or manufacturing updates.

3.2 Pricing
All prices displayed are in South African Rand (ZAR) and include VAT where applicable, unless otherwise stated.

We reserve the right to:

  • Change prices,

  • Correct obvious errors or omissions, and

  • Introduce or cancel promotions at any time.

If a material pricing error affects your order, we will contact you and give you the option to:

  • Confirm the order at the correct price; or

  • Cancel the order and receive a refund for any amounts already paid.

3.3 Availability
Products are subject to availability. Because we use dropshipping partners and suppliers, stock levels may change without notice.

If an item becomes unavailable after you place an order, we will:

  • Inform you as soon as reasonably possible; and

  • Offer a refund, an alternative product (if available), or a backorder with a later delivery date.

4. Orders & Payment

4.1 Placing an order
When you place an order:

  • You are making an offer to purchase the selected products at the prices displayed;

  • We reserve the right to accept or decline your order.

We will confirm receipt of your order via email. Acceptance of the order and conclusion of the sale occurs when:

  • Your payment is successfully processed, and

  • We dispatch the products or otherwise confirm acceptance.

4.2 Payment methods
We may accept one or more of the following (depending on what you set up):

  • PayFast or other payment gateway;

  • Other methods specified at checkout.

All payments are processed securely by our payment gateway provider. We do not store your full card details on our systems.

4.3 Security
We take reasonable technical and organisational steps to safeguard your information, but no system is completely secure. You are responsible for keeping your login details confidential and for all activity under your account.

5. Shipping & Delivery

Our Shipping & Delivery Policy forms part of these Terms.

Key points (summary):

  • We currently deliver to addresses within South Africa only.

  • Delivery times are estimates and may vary due to courier delays, supplier processing, public holidays or other factors.

  • Delivery fees are shown at checkout.

  • Risk passes to you once the order is delivered to the address you provided and signed for or otherwise reasonably confirmed.

6. Returns, Refunds & Defective Products

Our Return & Refund Policy forms part of these Terms.

In summary:

  • You may have a 7-day cooling-off period for certain online purchases, subject to legal requirements.

  • We offer a voluntary change-of-mind return for most unused toys and educational products within a specified period, subject to conditions.

  • Defective or faulty products are covered by a 6-month implied warranty under South African consumer law (for manufacturing defects or quality issues, not normal wear and tear, misuse or accidental damage).

  • Certain items may be non-returnable for hygiene/safety reasons once opened (this will be clearly marked).

7. Toys, Safety & Age Recommendations

Many of our products are intended for children and may contain small parts or other features requiring supervision.

By purchasing and using our products, you acknowledge and agree that:

  • You will read and follow all age recommendations, warnings and instructions.

  • You will ensure that children are appropriately supervised when using the products.

  • You will not allow children below the recommended age or developmental stage to use products that are unsuitable for them.

We are not responsible for injury, loss or damage arising from:

  • Use of products contrary to instructions, warnings or age recommendations; or

  • Lack of reasonable supervision.

This does not limit your legal rights regarding defective products but clarifies your responsibilities for safe use.

8. Intellectual Property

Unless stated otherwise, all:

  • Website content,

  • Text, graphics, logos, icons,

  • Photos and product images, and

  • Design and layout of the site

are owned by or licensed to Joyful Jellybeans and are protected by copyright and other intellectual property laws.

  • Copy, reproduce or distribute content for commercial use without our prior written permission;

  • Use our name, logo or branding in a way that may cause confusion or imply endorsement without consent.

You may print or download limited content for personal, non-commercial use only, provided you do not modify any notices or attribution.

Our website may contain links to third-party websites, services or tools (including payment gateways, courier tracking pages or supplier information).

  • We do not control and are not responsible for the content, security or privacy practices of third-party sites.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, consequential or special loss or damage (including loss of profits, loss of data, or business interruption) arising from your use of the website or products.

  • Our total liability to you for any claim relating to a specific product will not exceed the purchase price paid for that product.

Nothing in these Terms is intended to:

  • Exclude or limit any rights you have as a consumer under applicable South African law (such as the Consumer Protection Act), or

  • Exclude or limit liability for death or personal injury caused by our gross negligence or wilful misconduct.

11. Privacy & Personal Information

We process your personal information in accordance with applicable data protection laws, including the Protection of Personal Information Act (POPIA), and our Privacy Policy.

By using the website and placing orders, you consent to:

  • The collection, use and storage of your personal information as outlined in our Privacy Policy, and

  • Communication relating to your orders, account and customer service.

We will not sell your personal information to third parties. We may share information with service providers (e.g. couriers, payment processors) only as necessary to fulfil your orders and run our business.

12. Changes to the Website & These Terms

We may:

  • Update, suspend or discontinue any part of the website; and

  • Change these Terms from time to time.

Changes to the Terms will be effective when posted on the website with an updated “Last updated” date.

The version of the Terms in place at the time of your order will apply to that order, unless a change in law requires otherwise.

These Terms are governed by the laws of the Republic of South Africa.

If a dispute arises, we encourage you to contact us first so we can try to resolve it informally. If we are unable to reach a resolution, the dispute may be referred to:

  • An agreed dispute resolution body (such as mediation), or

  • The competent courts of South Africa.

14. General

  • If any provision of these Terms is found to be invalid or unenforceable, that provision will be applied to the extent permitted by law and the rest of the Terms will remain in full force.

  • Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.

  • You may not cede, assign or transfer your rights and obligations under these Terms without our prior written consent.
